Protecting the Rights of People with Autism in the Fields of Education and Employment: International, European and National Perspectives

The Council of Europe and the European Union (EU) have not developed ad hoc legal rules or hard law instruments specifically aimed at protecting the rights of people with autism. At European regional level, the special situation and needs of individuals with autism find recognition and protection within the wider legal framework concerning the rights of persons with disabilities as well as within the scope of application of the general principle of equality and non-discrimination. This paper focuses on hard law instruments and provisions adopted by the Council of Europe and the EU concerning the rights of people with disabilities and soft law instruments dealing specifically with the rights of people with autism. Relevant case-law of the Court of Justice of the European Union, the European Court of Human Rights and the European Committee of Social Rights are also highlighted.
